Return / Cancellation Policy

1. GENERAL POLICY

Artwork offered through Bird Swatch Archive is generally original, unique, or limited-edition work sold by participating Artists.

Unless otherwise stated for a particular Work or required by applicable law, all artwork sales are final.

Bird Swatch Archive does not ordinarily accept returns or cancellations based solely on:

  • change of mind;
  • personal preference;
  • the artwork not fitting the intended space;
  • differences in perceived scale;
  • minor variations characteristic of handmade work;
  • differences between screen color and physical artwork; or
  • other subjective preferences unrelated to a material problem with the order.

Nothing in this policy limits any right or remedy that cannot lawfully be waived or excluded.

2. BEFORE PURCHASING

Collectors should review the artwork listing carefully before completing a purchase.

Artwork listings may include:

  • Artist name;
  • artwork title;
  • medium;
  • dimensions;
  • year;
  • retail price;
  • edition information;
  • framing information;
  • artwork images;
  • shipping information; and
  • other relevant details.

Collectors are responsible for confirming that the artwork's dimensions, medium, appearance, and other disclosed characteristics are suitable before completing checkout.

3. ORDER CANCELLATION BY THE COLLECTOR

A Collector may request cancellation of an order before the artwork has entered fulfillment.

Submitting a cancellation request does not guarantee that the order can be cancelled.

Once the Artist has begun fulfillment, purchased shipping, packed the artwork, or transferred the shipment to a carrier, cancellation may no longer be available.

Collectors should contact Bird Swatch Archive promptly if a cancellation request is necessary.

Bird Swatch Archive will determine whether cancellation remains operationally possible based on the status of the order.

4. CANCELLATION BEFORE SHIPMENT

If Bird Swatch Archive approves a Collector cancellation before shipment, the order may be cancelled and eligible amounts refunded according to the applicable payment and refund process.

Shipping charges that have not been incurred should ordinarily be included in the refund.

If nonrecoverable shipping, payment-processing, insurance, or other transaction costs have already been incurred, treatment of those costs will be determined according to the final attorney-reviewed terms.

5. CANCELLATION AFTER SHIPMENT

Once a Work has been transferred to the carrier, the order ordinarily cannot be cancelled.

The Collector should not:

  • refuse delivery;
  • redirect the shipment;
  • return the package to sender;
  • independently ship the artwork back to the Artist; or
  • initiate a return without authorization from Bird Swatch Archive.

Unauthorized returns may result in additional shipping, insurance, storage, or handling costs and do not automatically create a right to a refund.

6. FINAL SALE

Unless an exception described in this policy applies, a successfully delivered Work is considered a final sale.

Final-sale status does not prevent a Collector from reporting:

  • shipping damage;
  • a lost shipment;
  • an incorrect artwork;
  • a materially misdescribed Work;
  • a fulfillment error; or
  • another issue for which applicable law requires a remedy.

7. DAMAGED ARTWORK

Artwork damaged during shipment is handled under the Bird Swatch Archive Shipping / Damage / Loss Policy.

Damage must be reported to Bird Swatch Archive within 48 hours of carrier-confirmed delivery.

The Collector must retain:

  • the artwork;
  • exterior packaging;
  • interior packaging;
  • shipping materials; and
  • shipping label

while the claim is being reviewed.

A damage report does not automatically authorize a return or guarantee a refund.

Bird Swatch Archive will determine the appropriate resolution after reviewing the available documentation and applicable carrier or insurance requirements.

8. LOST SHIPMENTS

If a shipment appears to be lost, the Collector should notify Bird Swatch Archive.

Bird Swatch Archive may coordinate a carrier investigation, insurance claim, or other fulfillment review before determining that a shipment is permanently lost.

A shipping delay alone does not create an automatic right to cancellation or refund.

Where a shipment is confirmed lost and cannot reasonably be delivered, Bird Swatch Archive may approve an appropriate resolution under the applicable purchase and shipping terms.

9. DELIVERED BUT NOT RECEIVED

If tracking shows a shipment as delivered but the Collector cannot locate it, the Collector should notify Bird Swatch Archive promptly.

Before opening a claim, the Collector may be asked to:

  • verify the shipping address;
  • review carrier delivery information;
  • check the delivery location;
  • check with household members;
  • check with building staff or reception where applicable; and
  • check nearby secure delivery locations.

A carrier delivery scan does not by itself determine final legal responsibility for a missing package.

10. INCORRECT ARTWORK

If the Collector receives a Work different from the artwork identified in the order confirmation, the Collector should notify Bird Swatch Archive promptly.

The Collector should not ship the Work back independently.

Bird Swatch Archive will coordinate an appropriate return, replacement where possible, or refund.

Bird Swatch Archive will provide return instructions if a return is required.

11. MATERIALLY MISDESCRIBED ARTWORK

If the Collector believes the Work materially differs from the description presented at the time of purchase, the Collector should contact Bird Swatch Archive promptly.

Examples may include a material discrepancy involving:

  • identity of the artwork;
  • dimensions;
  • medium;
  • edition information;
  • condition;
  • framing;
  • authenticity; or
  • another material factual characteristic of the Work.

Differences resulting solely from screen display, photography, lighting, or subjective interpretation ordinarily do not constitute material misdescription.

Bird Swatch Archive may request photographs or other documentation before determining the appropriate resolution.

12. COLOR VARIATION

Artwork images displayed online are digital representations.

Color may vary because of:

  • monitor or phone settings;
  • display technology;
  • browser settings;
  • photography;
  • ambient lighting;
  • printing processes; and
  • the characteristics of the physical materials.

Reasonable color differences between a digital image and the physical Work are not, by themselves, grounds for a return.

13. HANDMADE AND MATERIAL VARIATION

Original artwork may include characteristics arising from the Artist's materials or process.

These may include minor variations in:

  • texture;
  • edges;
  • paper;
  • canvas;
  • pigment;
  • surface;
  • printing;
  • framing; or
  • other handmade characteristics.

Such characteristics are not necessarily defects where they are consistent with the nature of the Work and its description.

14. AUTHORIZED RETURNS

A Work may be returned only when Bird Swatch Archive has expressly authorized the return.

If a return is authorized, Bird Swatch Archive will provide instructions regarding:

  • return destination;
  • carrier;
  • shipping label;
  • packaging;
  • tracking;
  • insurance;
  • timing; and
  • any required documentation.

The Collector must follow the return instructions provided.

The Artist and Collector should not independently arrange an alternative return without Bird Swatch Archive approval.

15. RETURN PACKAGING

An authorized return must be packed with reasonable care.

Where possible, the Collector should reuse the original shipping materials if they remain safe and suitable.

The Collector should photograph the Work and return packaging before shipment when requested.

If Bird Swatch Archive supplies a return shipping label, that label must be used unless another arrangement is expressly authorized.

16. CONDITION OF RETURNED WORK

Where a return is authorized, the Collector must preserve the Work in the condition in which it was received, except for damage that is the subject of the claim.

The Collector should not:

  • repair the Work;
  • alter the Work;
  • remove framing;
  • clean the Work;
  • modify the Work;
  • discard components; or
  • otherwise materially change its condition

unless instructed by Bird Swatch Archive.

A refund may be delayed while the returned Work is inspected.

17. RETURN SHIPPING COSTS

Responsibility for return shipping depends on the reason for the authorized return.

Where a return results from verified shipping damage, an incorrect Work, a material fulfillment error, or another issue attributable to the transaction, Bird Swatch Archive may arrange or cover appropriate return shipping.

Where a discretionary return is exceptionally approved for another reason, the Collector may be responsible for return shipping and related costs.

18. REFUNDS

Approved refunds will generally be issued to the original payment method where technically and legally possible.

Refund processing times may depend on the payment provider and the Collector's financial institution.

An approved refund may include some or all of:

  • artwork purchase price;
  • original shipping charge;
  • taxes; and
  • other transaction amounts

depending on the reason for the refund and applicable law.

Bird Swatch Archive will not promise a particular refund amount until the claim or cancellation has been reviewed and approved.

19. PARTIAL REFUNDS

In some circumstances, Bird Swatch Archive and the Collector may agree that a partial refund is an appropriate resolution.

Examples may include a minor documented condition issue where the Collector wishes to retain the Work.

A partial refund will not be issued without the Collector's agreement to the resolution.

20. REFUND AFTER RETURN

Where return of the Work is required, Bird Swatch Archive may wait until:

  • carrier tracking confirms return delivery;
  • the Work has been received;
  • the Work's condition has been reviewed; and
  • any necessary claim documentation has been completed

before issuing the final refund.

This does not limit any faster refund timing required by applicable law.

21. EDITIONED WORK REPLACEMENT

For Photography or other editioned Works, replacement may sometimes be possible instead of a refund.

A replacement may be offered only where:

  • another valid impression is available;
  • the Artist's edition records permit the replacement;
  • the represented edition size is not improperly increased;
  • the replacement is authentic and appropriately documented; and
  • the Collector agrees to the replacement.

Replacement is not guaranteed.

22. REPAIRS

Where a damaged Work can reasonably be repaired, Bird Swatch Archive may discuss a repair option with the Artist and Collector.

No repair should be undertaken without the Collector's agreement.

The Collector should not independently repair the Work while a claim is pending.

23. ARTIST CANCELLATION OR INABILITY TO FULFILL

If the Artist becomes unable to fulfill a paid order before shipment, the Artist must notify Bird Swatch Archive immediately.

The Artist should not independently cancel the Collector's order.

Bird Swatch Archive may cancel the order when fulfillment cannot reasonably be completed.

If Bird Swatch Archive cancels a paid order because the Artist cannot supply the purchased Work, the Collector will receive the applicable refund according to the final transaction terms.

The Artist payout for the cancelled order will not be released.

24. CANCELLATION BY BIRD SWATCH ARCHIVE

Bird Swatch Archive may cancel an order when reasonably necessary, including where:

  • payment cannot be confirmed;
  • the Work is unavailable;
  • the Artist cannot fulfill the order;
  • a material pricing or listing error occurred;
  • shipping cannot reasonably be completed;
  • fraudulent or unauthorized activity is suspected;
  • fulfillment would violate applicable law; or
  • another material transaction problem prevents completion.

If Bird Swatch Archive cancels a paid order before successful completion, amounts collected will be handled under the applicable refund terms.

25. PRICING ERRORS

Bird Swatch Archive may correct obvious pricing, shipping, tax, or listing errors.

If a material pricing error is identified after an order has been placed but before fulfillment is completed, Bird Swatch Archive may cancel the transaction and issue the appropriate refund rather than requiring either party to complete a transaction based on an obvious error.

26. PAYMENT REVERSALS AND CHARGEBACKS

Collectors should contact Bird Swatch Archive regarding a purchase issue before initiating a payment dispute where reasonably practicable.

A chargeback or payment dispute does not automatically establish entitlement to retain the artwork without payment.

Bird Swatch Archive may provide order, shipping, tracking, acceptance, policy, and claim documentation to the applicable payment processor or financial institution when responding to a dispute.

27. ARTIST PAYOUTS

Artist payouts associated with an order may be placed on hold while a material cancellation, return, damage, loss, refund, fraud, or payment dispute is unresolved.

For delivered orders, Artist payout eligibility should ordinarily begin only after the 48-hour damage-reporting window has expired without an open claim, subject to the applicable payout schedule.

If a claim is opened, the payout remains on hold until the applicable issue is resolved.

28. NO DIRECT REFUNDS BETWEEN ARTIST AND COLLECTOR

Artists should not independently:

  • refund Collectors;
  • request additional payment;
  • reimburse shipping;
  • negotiate financial settlements; or
  • arrange replacement transactions

outside the Bird Swatch Archive order workflow.

Financial resolutions should be administered through Bird Swatch Archive so that the order, payout, refund, tax, and audit records remain accurate.

29. RETURN FRAUD AND ABUSE

Bird Swatch Archive may investigate return, damage, cancellation, or refund requests where there is a reasonable indication of fraud, misuse, altered documentation, payment abuse, or intentional damage.

Bird Swatch Archive may deny a request where the available evidence reasonably establishes that the request is fraudulent or falls outside the applicable policy, subject to applicable law.

30. LEGALLY REQUIRED RIGHTS

Nothing in this policy is intended to waive, limit, or exclude consumer rights that cannot legally be waived, limited, or excluded.

Where applicable law provides a Collector with rights that conflict with this policy, the applicable legal requirement will control.

31. POLICY VERSION

The Return / Cancellation Policy applicable at the time of purchase will be associated with the Collector's order.

Later changes to this policy will not retroactively alter the policy version attached to an existing completed transaction.

Bird Swatch Archive should retain:

  • policy version;
  • effective date;
  • complete policy snapshot or immutable revision;
  • order association; and
  • acceptance record where applicable.

32. CONTACT AND REQUESTS

Cancellation, return, refund, damage, and fulfillment requests must be submitted through the Bird Swatch Archive order support or claim process designated for the applicable transaction.

Collectors should include the applicable order number when contacting Bird Swatch Archive.
